Conviction of a teenager for sexual assault in the Aktobe region modified to leniency in sentence
The Aktau Regional Court handed down a sentence to a 17-year-old boy on November 24, following an appellate hearing. The boy was found guilty of repeatedly engaging in sexual intercourse with a 15-year-old minor, an incident that began last fall.
According to the law, the boy, who was 16 at the time of the offence, incurred responsibility for voluntary sexual intercourse as the victim was under 16 years of age. The court took into account the teenager's remorse, the opinion of the victim and her legal representative, and a positive character reference as mitigating circumstances.
The story of the two teenagers started when they fell in love and began meeting secretly, even running away from home. However, after one such incident, the girl's mother demanded a DNA test, leading to the boy's criminal charges.
The court sentenced the teenager to 1 year and 6 months of restricted freedom, a sentence lighter than that prescribed by the statute. The lighter sentence was based on Article 55, Part 4 of the Criminal Code, which allows for a reduced sentence in cases where there are exceptional mitigating circumstances.
Despite the mother of the 15-year-old girl later regretting filing the complaint, it was too late. The boy was released from custody after receiving his sentence.
It is important to note that if the sexual intercourse was repeated, the punishment ranges from 10 to 15 years in prison for a grave crime. The exact date and full name of the boy are not publicly specified to protect the privacy of the individuals involved.
The case serves as a reminder of the seriousness of such actions and the potential consequences they can have, even for young people. It also underscores the importance of understanding and respecting the age of consent laws in place to protect minors.
