Furth Forest's Local Entrepreneur, Identified as HZA-R, Faces Conviction After Self-Employment Trial
In a significant ruling, a metal systems company based in the Cham district has been convicted for violating social security regulations by employing three workers as supposedly self-employed from 2016 to 2021. The company, which sells and installs metal systems, was found guilty in the Regensburg Local Court.
The investigations by the Regensburg Customs Office uncovered this tax evasion. The company, in an attempt to save approximately 165,000 euros in social security contributions, failed to report these wages to the social security office. In reality, the installers worked like regular employees within the company, with total wages paid to them amounting to nearly 1.5 million euros.
The Regensburg Public Prosecutor's Office filed charges of withholding and misappropriation of wages against the company owner. As a result, the company has been convicted for the evasion of social security contributions and the owner is required to pay the withheld contributions and court costs.
The Regensburg Local Court sentenced the company owner to a total fine of 51,150 euros. Wolfgang Braun, an investigator with the Financial Control Black Work unit, based in Furth im Wald, emphasized the importance of uncovering pseudo-self-employment cases. Pseudo-self-employment is considered unfair as it gives an advantage to some companies while honest companies pay their contributions. Employees suffer from pseudo-self-employment as they lose pension or health insurance claims.
The Financial Control Black Work unit is tasked with ensuring fairness in the labor market. This case serves as a reminder of the importance of adhering to social security regulations and the consequences of evading them. Pseudo-self-employment is not only illegal but also unfair to honest businesses and employees who comply with the law.
