"Germany witnesses a stir in the gender discourse as a self-proclaimed 'Trans' neo-Nazi emerges on the scene"
Marla-Svenja Liebich, a former high-profile figure in eastern Germany's right-wing extremist scene, has caused a stir by missing her prison sentence. Liebich, who was due to report to JVA Chemnitz women's prison to begin an 18-month term for offences including incitement to racial hatred and slander, did not show up.
The controversy surrounding Liebich has sparked a debate about Germany's Self-Determination Act, a law that allows adults to change their name and gender without providing a reason or medical information. The act, introduced in 2022 under Chancellor Olaf Scholz's government, replaced the former Transsexuellengesetz.
Liebich's gender switch in 2024, registering a new identity as a woman, was widely seen as an attempt to mock the Self-Determination Act. This interpretation was further fuelled by Liebich's decision to request kosher meals and rabbinical supervision in prison, a move that Germany's antisemitism commissioner, Felix Klein, condemned as making "a mockery not only of Jews, but of all religious people, regardless of their faith".
The decision to send Liebich to the Chemnitz women's jail was based on their "registered gender and place of residence". However, LGBTQ activists argue that repealing the Self-Determination Act would lead to more discrimination. On the other hand, family affairs minister, Karin Prien, stated that the law in its current form "contains weaknesses that could encourage targeted abuse".
The queer rights commissioner Sophie Koch warned against "falling for the tricks of right-wing agitators" in the Liebich case. Meanwhile, Germany's new coalition government, led by the conservative CDU/CSU alliance, has pledged to review the Self-Determination Act.
Liebich's actions have not been limited to the gender switch. In 2022, Liebich disrupted an LGBTQ pride parade in Halle, calling the participants "parasites on society". Liebich was a member of the banned Blood and Honour group and ran an online business selling products popular with xenophobic groups, including a baseball bat with the slogan "deportation assistant".
A police spokesman confirmed a small crowd of Liebich's supporters outside the prison received an audio message about the apparent escape plan. Liebich posted a message on social media saying "Love from Moscow", implying an escape plan. However, the whereabouts of Liebich remain unknown.
The controversy surrounding Liebich and the Self-Determination Act continues to divide opinions, with some arguing for the protection of individual rights and others for the need to prevent abuse. The review of the act by the new government is expected to shed more light on the issue.
Once an individual is admitted to prison, an individual review is carried out, according to prosecution spokesman Benedikt Bernzen. It remains to be seen what the outcome of this review will be for Marla-Svenja Liebich.
