In a significant ruling, the Federal Court of Justice (BGH) in Karlsruhe has partially overturned a verdict by the Hamburg Regional Court on two individuals involved in a large-scale drug smuggling operation.
The operation, which involved 2.3 tons of cocaine, was uncovered by German customs and police authorities in Hamburg. The drugs, hidden in containers of canned asparagus, were destined for the Netherlands.
The original convictions and sentences of the two individuals, a Cologne vegetable trader and his accountant, were called into question. The BGH has changed the conviction of the Cologne vegetable trader from drug smuggling to aiding and abetting the importation of drugs. The accountant's conviction for aiding and abetting remains unchanged.
The new ruling will affect the sentencing of the Cologne vegetable trader. His eleven-year prison sentence has been overturned, and a new sentencing hearing will take place before a different chamber of the Hamburg Regional Court. The location of the new hearing has not been announced yet.
The tip-off about the seizure came from Peruvian authorities, indicating that the cocaine originated from Peru. The second man, the accountant, was found to have played a role in the operation, but the BGH did not uphold his conviction for the joint commission of the importation of narcotics in large quantities.
The appeal of the second man, who was originally sentenced to seven years in prison for aiding and abetting, was rejected. His sentence remains unchanged.
