Lawsuit challenging Forest Service's timber management plans in White Mountains proven groundless, deemed unnecessary by judge
In a ruling last week, Judge Joseph Laplante of the U.S. District Court for the District of New Hampshire dismissed a lawsuit filed by the environmental group Standing Trees. The lawsuit aimed to halt the Tarleton and Peabody West projects, two logging plans developed by the Forest Service in the White Mountain National Forest.
Standing Trees argued that the Forest Service bypassed a required environmental review under the National Environmental Policy Act (NEPA). However, the Forest Service maintained that they had met their legal obligations under the act.
The lawsuit, filed by the Vermont Law and Graduate School Environmental Advocacy Clinic in May 2024, requested a thorough review before the projects could proceed. Unfortunately, as of the ruling, no such review had been conducted on the Tarleton and Peabody West projects.
If allowed to proceed, the Tarleton and Peabody West projects would permit logging of 3,000 acres and construct over 11 miles of permanent roads in the national forest. The projects are part of the Forest Service's plans for logging in the White Mountain National Forest.
Despite the rejection of the lawsuit, Standing Trees, an organization focused on protecting and restoring New England's forests, continues to advocate for environmental protection and responsible forest management. The group has not yet announced if they will appeal the ruling.
The ruling has sparked debate among environmentalists, forestry professionals, and local communities, with some expressing concern about the potential impact on the national forest and its ecosystems, while others argue for the economic benefits of sustainable forestry practices. The discussion is likely to continue as the Forest Service moves forward with its plans.
