Legislative Amendments in Judiciary

In an effort to streamline the Indian judiciary, key initiatives have been set in motion to address various issues and promote efficiency.

One of the primary concerns is the pendency of cases, which costs the country 1.5%-2% of its GDP. To tackle this, Fast Track Courts and specialized courts and tribunals are being established for faster resolution. Additionally, Alternative Dispute Resolution (ADR) mechanisms are being promoted to reduce the burden on courts.

Another significant issue is the trust deficit due to lack of transparency. To address this, efforts are being made to increase transparency and accountability within the judiciary. The National Mission for Justice Delivery, a key initiative for reform, is playing a crucial role in this regard.

Financial constraints are also hindering modernization efforts in the Indian judiciary. The e-Courts Project, a part of the National Mission for Justice Delivery, is being considered for expansion. This project aims to digitize and implement AI-assisted case management to improve efficiency and reduce costs.

Infrastructure gaps are another challenge faced by the Indian judiciary. To address this, the focus is on improving the physical infrastructure of courts to ensure they are equipped to handle cases efficiently.

Diversity is another concern, with a lack of representation from women, Scheduled Castes (SCs), Scheduled Tribes (STs), and Other Backward Classes (OBCs) in the Indian judiciary. Strengthening of legal aid services and public awareness campaigns is being considered to encourage participation from underrepresented groups.

The judicial appointment process is also under consideration for reform. The aim is to ensure a more transparent and efficient process that results in prompt filling of vacancies.

However, resistance to change within the Indian judiciary persists. To overcome this, efforts are being made to educate and train judges and other judicial officials on the benefits of modernization and reform.

The Indian government is also playing a role in the reform of the judicial system. Ministers are introducing constitutional amendment bills, though the specific judges or lawyers participating in the reform are not yet specified in the search results. In August 2025, the Indian government introduced three constitutional amendment bills affecting ministerial removal, highlighting legislative involvement rather than judicial figures.

Legal Aid Initiatives like Tele-Law and Nyaya Bandhu programs are also part of the key initiatives for reform in India. These initiatives aim to provide legal aid to the underprivileged and ensure justice is accessible to all.

Despite the challenges, the Indian judiciary is taking steps towards reform to ensure a more efficient, transparent, and accessible system for all.
