Online Resource Launched for EU Passengers: Confirmation of Passenger Rights
The European Union (EU) has a Flight Compensation Regulation in place to protect travelers within Europe, and now, the European Consumer Centre (ECC) Germany has developed a digital tool to help individuals determine their rights under this regulation.
Currently, a reform of the Flight Compensation Regulation is being negotiated between the European Parliament and Council. However, the organization that has expressed clear criticism about the potential changes is the European Consumer Organisation (BEUC). The network of European Consumer Centres (ECC-Net) has also voiced concerns, warning of a noticeable deterioration in the legal situation for passengers.
The new flight rights tool allows users to select the respective problem, answer a few targeted questions, and immediately receive an overview of their rights. Passengers arriving in the EU with a European airline are also covered by the regulation.
If a flight is cancelled, airlines must either refund the full ticket price or offer an alternative flight to the destination. Depending on when the cancellation was announced, additional compensation may be due. Strikes are only considered exceptions if they are outside the airline's control.
In any case, the airline is obliged to provide adequate care for those affected. From a two-hour delay at departure, passengers are entitled to care services, including meals, drinks, and overnight hotel stays if necessary. If an agreement cannot be reached, the claim can be enforced through the simplified European small claims procedure.
The final version of the regulation is not expected before autumn 2025, and entry into force is not expected before 2027. It's worth noting that no compensation is due in cases of extraordinary circumstances, such as severe weather or volcanic eruptions.
If a flight arrives at its destination at least three hours late, a compensation payment of between 250 and 600 euros can be claimed, depending on the distance of the flight. The planned changes could lead to a weakening of consumer protection, particularly in compensation payments.
