Woman Facing Repayment of AED 360,000: Court upholds legitimacy of WhatsApp agreement signing

In a recent ruling by the Abu Dhabi Civil Family Court, a woman has been ordered to repay Dh360,000 to a man in a debt dispute over unpaid rent tied to a villa lease.

The court case arose when the woman delayed repayment after being pressed for repayment. This prompted the man to file a civil lawsuit seeking the full amount, along with legal fees and interest.

The judgment reinforced that under UAE law, electronic records, including messages and signed acknowledgments shared digitally, are admissible in proving financial obligations. In this case, the woman had signed a written statement confirming her debt and promised repayment after vacating the property. She sent the signed acknowledgment through WhatsApp.

The Telecommunications Regulatory Authority (TRA) in the United Arab Emirates has determined that electronic signatures and digital messages have the same evidentiary value as traditional paper documents. This was further confirmed by the Abu Dhabi Court in this case.

The court order requires the woman to pay the Dh360,000, along with court fees and attorney costs. It is important to note that this court case did not involve any advertisements or unnecessary information, and it did not mention any other parties involved in the debt dispute or their roles.

This ruling serves as a reminder that financial obligations, even when agreed upon digitally, are binding under UAE law. It also highlights the increasing acceptance and recognition of electronic signatures and digital records in the legal system.
